Terms of Service

You are bound to these Terms of Service as soon as you paid for the commission(s). Failing to adhere will result in a blacklist and possible legal actions.

Disclaimer

  • The Terms of Service (TOS) may change at any given time without warning.
  • Clients (henceforth called "you") are bound to the TOS at the time of purchase however.
  • The artist (henceforth called "I") reserves the right to decline your request at any point of the discussion. No specific reason needs to be given.
  • For ease of licensing, my commissions are for PRIVATE people for NON-COMMERCIAL purposes.
  • I will NOT do commissions for corporate bodies or individuals whose identities are tied to one.

Pricing

  • If you want or need to stay within a lower budget, I can adjust. Do be aware, however, that that means I cannot/will not put in as much effort as intended. The final product may deviate from the samples shown then.
  • I reserve the right to adjust the prices stated otherwise during the discussion. This can go in my favor or in yours.
  • If I deem a design too complicated, an extra fee may apply.
  • If you cannot provide more references, I reserve the freedom to interpret strange unknown parts of the design as I wish. I may also simplify the design if you cannot pay the extra.
  • Payment will be done via PayPal Invoicing. For that you must provide your E-mail address.

Client Rights

  • You may use the commissioned art for personal NON-COMMERCIAL purposes, meaning you must not profit with the commissioned art (e.g. making merchandise and selling them). This includes NFTs as well as the training of an AI model.
  • Using the art for your own promotion or in streams is fine, but you must give credit or use a watermarked version.
  • You may ask for constant updates. During the sketch process, you may ask for five (5) corrections, afterwards you may only request color corrections or small additional details.
  • You will receive the original full-size file without watermark. Upon request, I will add a version with watermark.
  • You are not allowed to claim the commissioned work as your own!

Refunds, Deadlines and Delivery

  • The commission will only be finalized once the money has been transferred.
  • You may ask for (partial) refunds as long as I have not completely finished the commission by the time of your refund request. The amount of refund shall be discussed by both parties but is ultimately decided by the artist.
  • Although I am known for my ridiculous speed, please allow me up to 4 weeks’ time before requesting a refund.
  • By the time I have sent the finished work, no refunds will be given.
  • Finished is the version after all the limited requested changes; there is no need for the client's verbal agreement. Minimal changes may still be made on a friendly basis outside of the commission framework but are not guaranteed.
  • You may set a deadline for me. It can be as short as 7 days after the payment but depending on the scope of the commission, my current workload, my own personal life circumstances and/or a lack of communication between artist and client, a tight deadline may not be able to be upheld.
  • If you do decide to ghost me, the commission will be on hold until you reply and I can continue working on it. After 2 weeks of no answer, you waive your right for refund.
  • Please know, you are not required to tell me about your personal life circumstances. A simple "Give me some time" to inform me is enough. Just please do not ignore the one whose services you paid for.
  • If beforehand you give me full artistic freedom, you waive your right for refund.
  • Waiving your right for refund does NOT mean I will not deliver. I will deliver a finalized product.

Communication

  • Communication will take place wherever you wish.
  • I can only promise reliable and constant communication via Discord. Needless to say, even if my status says online, it does not mean I can always reply with no delay!
  • You are free to remove me from your friendlist after the commission is done.
  • Your first tone will determine my tone. Be formal and I will be formal; be casual and I will be casual. This does not mean I will not be professional, however!
  • When a deadline has been decided, I expect you to reply as soon as possible when I ask for feedback. If I have not received artistic freedom beforehand, I will not be able to continue work otherwise. For every day that I received no reply, the deadline will be pushed back accordingly.
  • I will still try to uphold the original deadline but you are not allowed to complain if I cannot do so.

Non-Disclosure Agreement

  • All work I do automatically falls under a non-disclosure agreement (NDA) without additional fees.
  • I am not going to share progress online or offline. I am not going to record or stream the work.
  • I am allowed to show the work, progress and/or behind-the-scenes after the work has been officially published or shared by the client themselves.
  • If the client wishes otherwise, the NDA can be voided.
  • This, however, does not mean I will share the work if I do not want to.

After a commission has been accepted, we can move to whichever communication platform you want.
Reliable and constant communication from my side can only be granted via Discord. For privacy's sake, the exchange of handles will only take place after confirmation.
